Terms and Conditions

Tanner Medical Center, Inc. is pleased to offer you access to Tanner MyChart. Tanner Medical Center, Inc. offers Tanner MyChart access to you conditioned on your acceptance of ALL of these terms and conditions, which shall govern your use of the Tanner MyChart services and system.

Tanner MyChart terms and conditions

By clicking on "Accept", you accept without modification all of the Tanner MyChart Access Terms and Conditions contained herein (“Terms and Conditions”) and acknowledge and agree that these Terms and Conditions are a binding agreement between you and Tanner Medical Center, Inc. If you do not agree to these Terms and Conditions, you must decline them and not use Tanner MyChart.

In consideration of your agreement to these Terms and Conditions and for other valuable consideration, Tanner Medical Center, Inc. grants to you a nonexclusive, nontransferable, limited, terminable license to access and use Tanner MyChart only when you are physically located in the United States. Tanner Medical Center, Inc. reserves all rights not expressly granted in this agreement including the right to revoke the license without notice or cause.

To improve our ability to serve you, Tanner Medical Center, Inc. may make modifications, improvements, deletions, or amendments to the Tanner MyChart system at any time we deem appropriate. Any and all relevant portions of this agreement will apply automatically to all modifications, improvements, deletions, and/or amendments as they appear.

What is Tanner MyChart?

When using Tanner MyChart, you understand that my Tanner is a patient portal that is a communication service offered as a convenience and privilege to Tanner Medical Center, Inc. patients. It is an Internet application that enables patients to have web-based access to portions of their Tanner Medical Center, Inc. electronic medical record, and allows a convenient communication channel with certain Tanner Medical Center, Inc. providers for non-urgent messages. Use of this service is optional and no fee will be charged to use it. You agree to use Tanner MyChart ONLY for non-emergencies and you understand that Tanner MyChart is NOT to be used if you feel the patient is having a medical emergency. You understand and agree that Tanner MyChart is NOT monitored 24 hours a day/seven days a week; so, there may be a delay in receiving a response during weekends and weekdays. For emergencies, you agree to go to closest emergency room, or dial 911 IMMEDIATELY.

You understand that Tanner MyChart provides online access to some portions of your Tanner Medical Center, Inc. medical record and that you are solely responsible for any sharing of its content that you intentionally or unintentionally communicate to others. You understand that messages will be routed to the appropriate department as necessary for handling, and therefore, Tanner Medical Center, Inc. employees, other than your healthcare provider or physician may be involved in addressing your request. Therefore, use of Tanner MYCHART is not appropriate for very sensitive information you wish to discuss only with your physician or other provider. In such circumstances where you desire to only share such information with your healthcare provider, it is your sole responsibility to ensure such information is not included in your messages being sent through Tanner MyChart. Electronic messages sent by you and responses from health care providers will be retained in the Tanner MyChart portal.

Account access

A patient must be 18 or older to request a personal account without parental or legal guardian consent. Parents or guardians of minor children may request access to the minor child’s account by following the terms outlined in this “Proxy Access” section of this Terms and Conditions statement.

Proxy access:

    1. Parents or guardians of minor children, age 0-17 (inclusive), may request proxy access to the child’s Tanner MyChart account by completing a Patient Portal Access Agreement and Authorization Form. Such access will only be granted to parties with parental rights or legal guardianship over the Tanner MyChart account holder. A Tanner MyChart account will be activated for the proxy. The proxy will access the child’s health information through the proxy account. If the proxy’s legal relationship with the account holder changes, the proxy must inform Tanner MyChart customer support immediately.
    2. Parental or legal guardianship access to adolescent patient’s Tanner MyChart requires completion of Access Agreement and Authorization From, including the adolescent’s signature. Proxy access to minor children’s Tanner MyChart will be deactivated on the child’s 12th birthday unless the minor child requests continued access for the proxy account holder.
    3. Minor children between the ages of 12-17, adolescent patient, may sign up for their own Tanner MyChart account and access their record independently, which may include confidential email with providers. Tanner MyChart accounts will only be provided to adolescents age 12-17 with parental or legal guardian consent.
    4. Due to limitations current imposed by state and federal law, certain sensitive health information of minors requires special handling. Due to this, Tanner only provides a limited data set through Tanner MyChart. Accounts will not contain any medical record sensitive information related to pregnancy, contraception, venereal disease, or substance abuse. Patients and parents/legal guardians still have full access through the Heath Information Management Department, except for specific specially protected conditions and diagnoses that require a minor’s authorization prior to releasing the information.
    5. At the age of 18, all proxy account relationships will be deactivated unless the patient requests continued access for the proxy account holder.
    6. Adults patients may grant proxy access to their Tanner MyChart account to other adults age 18 and over, by completing a Patient Portal Access Agreement and Authorization Form. This Adult-to-Adult Proxy access does not expire and shall remain active until the proxy access is revoked by either the adult patient from within their Tanner MyChart account, or by the patient notifying Tanner MyChart customer service and requesting the proxy access by revoked.
    7. Patients over the age of 18 who have limited ability to make healthcare decisions can continue to have an adult-to-adult proxy access relationship. A copy of the valid Durable Power of Attorney for Healthcare, legal guardianship documentation or a physician certification must be submitted as part of the enrollment process.

Services and responses

Tanner Medical Center, Inc. will use reasonable efforts to provide a timely response to electronic messages. While the anticipated turnaround time is two (2) business days during normal weekday business hours, this is only an estimate and not a binding a commitment. Further, Tanner MyChart will be monitored during normal business hours. Thus, if you determine a more urgent response is necessary, it is your responsibility to follow up and/or schedule an appointment if warranted.At this time, the following services are available through Tanner MyChart:

Prescription refills

First time prescriptions may not be requested and will not be called in through Tanner MyChart requests. First time prescriptions require an office visit and/or other consult directly with a physician. Refills may be requested through Tanner MyChart. It is common practice for your provider to require an office visit and/or consult before refilling your medications. Your provider will respond to you if an office visit is required for your refill. You agree to allow 48-72 weekday business hours for all refills requested through Tanner MyChart. Prescriptions for narcotics or certain other drugs may require an office visit prior to refill. Narcotics may not be refilled electronically and require a paper copy of an original prescription and must be picked up from the medical practice office. Failure to timely request a refill shall not constitute grounds for automatic waiver of this policy.

Privacy

Tanner Medical Center, Inc. will, at all times, use reasonable efforts to safeguard the confidentiality of your confidential medical information and will not intentionally disclose any such information to any unaffiliated third party unless you authorize that person to receive your information by providing access to Tanner MyChart or otherwise or the information is permitted to be disclosed by law. All messages sent and received within Tanner MyChart that contain medical information are subject to all state and federal laws governing the security and confidentiality of medical records. Please read Tanner Medical Center, Inc.’s Notice of Privacy Practices for more information.

Password

When you initially enroll in Tanner MyChart, you will be provided with an access code. The access code you receive will give you the opportunity to create a personal login name (called “Tanner MyChart ID”) and a password. You agree that you will keep your login name and password completely confidential. Anyone with access to your login name and password will be able to access your confidential medical information. That person will also be able to read your messages and send new messages as if they were you. It is your responsibility to prevent disclosure of your login and password, and to change your password if you feel that your security has been compromised. Your password is only known by you and can be changed online at any time by you. Your password is not known by anyone at Tanner Medical Center. It is recommended that you change your password every 30 days. You agree not to share your or the patient's username and password and to report to Tanner Medical Center, Inc. any lost or stolen username/password or inappropriate or suspicious use of Tanner MyChart. The Tanner MyChart help desk can be contacted at 770-812-6875.

Communications

You will be notified via e-mail when there is new information to be viewed on Tanner MyChart account. Therefore, this means that any person with access to your e-mail will be able to see this notification; this could include your spouse, employer or anyone else that can access your e-mail account. The notification that new medical information is available by accessing Tanner MyChart may be information that you would not want others to know. Thus, you should consider who has access to your e-mail address when providing an e-mail address for such notices to be sent.

Firewalls, passwords, encryption and other periodic quality oversight activities are used to safeguard your information and the communications between you and Tanner Medical Center, Inc. through Tanner MyChart (the "Security Measures"). While such Security Measures are used, you agree that security cannot ever be guaranteed due to new and unforeseen threats and Tanner Medical Center, Inc. shall not be liable for the failure of such Security Measures unless such failure is due to Tanner Medical Center, Inc.'s gross negligence or willful misconduct.

Appropriate use

Access to Tanner MyChart is granted to users for their convenience and to share information related to their medical care. Your use of the system unrelated to this purpose may result in the suspension or termination of your access privileges. Improper activities include, but are not limited to, the use of inappropriate or abusive language, reserving appointment times that are not needed or are cancelled and other activities that are deemed to cause a disruption to operations in the sole discretion of Tanner Medical Center, Inc. Tanner Medical Center, Inc. reserves the right to assess an appointment cancellation fee for appointments cancelled less than 24 hours prior to scheduled appointment time.

You agree to: (a) provide true, accurate, current and complete information about yourself as prompted and (b) maintain and promptly update your information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Tanner Medical Center, Inc. has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Tanner Medical Center, Inc. has the right to suspend or terminate your account and refuse any and all current or future use of the Tanner MyChart services (or any portion thereof).

If your use of Tanner MyChart violates these Terms and Conditions, Tanner Medical Center, Inc. reserves the right to permanently terminate access to Tanner MyChart.

Disclaimer

With respect to any electronic communications you send, your health care provider is only able to respond to such communications based on the information you have provided. You agree to provide ALL information regarding your medical history and symptoms. If there is insufficient information provided or an appointment is needed, your health care provider will be unable to provide accurate and reliable services through Tanner MyChart.

Tanner Medical Center, Inc. assumes no responsibility for how you use the information you obtain from Tanner MyChart. You should consult with a physician or other health care provider regarding your own condition and how the information in Tanner MyChart applies to you. Tanner MyChart access is not a substitute for consultation with your physician and Tanner MyChart does not include your entire medical record. You should never change or stop any course of treatment prescribed by your physician without first consulting him or her.

Tanner Medical Center, Inc. may restrict or terminate access to Tanner MyChart at any time, including, but not limited to times, where maintenance of the Tanner MyChart system is needed, or you have violated these Terms and Conditions. Access is provided on an "as is available" basis and you agree that access is not guaranteed at any particular time. You agree that Tanner Medical Center, Inc. shall not be liable to you for any modification, suspension or discontinuance of the Tanner MyChart services (or any part thereof).

You agree to hold harmless Tanner Medical Center, Inc. should any information be provided to someone who claims to be legally authorized to make healthcare decisions or any information that is lost while communicating online or if any information is disclosed to any other individual communicating with Tanner Medical Center, Inc. using your Tanner MyChart account. You understand that Tanner Medical Center, Inc. will not be able to check or verify the photo identification or legal paperwork or other the legal authority of each User of Tanner MyChart. Tanner Medical Center, Inc. will rely solely on the email address provided by the patient to reach out to allow access to Tanner MyChart.

The Tanner MyChart services and system are provided on an "as is" and "as available" basis. Tanner Medical Center, Inc. and its subsidiaries, affiliates, officers, employees, and agents expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of title, merchantability, fitness for a particular purpose and non-infringement. Tanner Medical Center, Inc. makes no warranty or representation that (a) the tanner MyChart services or system will meet your requirements; or (b) the tanner MyChart services or system will be uninterrupted, timely, secure or error-free.

You expressly understand and agree that Tanner Medical Center, Inc. and its subsidiaries, affiliates, officers, employees, and agents shall not be liable to you for any punitive, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of data or other intangible losses (even if Tanner Medical Center, Inc. has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Tanner MyChart services and system; (ii) unauthorized access to or alteration of your transmissions of data through the Tanner MyChart services and system due to no fault of Tanner Medical Center, Inc.; or (iii) statements made by, conduct of, or any information, services or goods provided by a third party.

Links and third-party information

You acknowledge and agree that Tanner Medical Center, Inc. is not responsible for the availability of such sites or resources and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Tanner Medical Center, Inc. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

These Terms and Conditions are effective until terminated by either you or Tanner Medical Center, Inc. Tanner Medical Center, Inc. may terminate these Terms and Conditions, with or without advance notice.
